Trademark renewal is an important legal process that allows the owner of a registered trademark to extend the validity of the mark after the initial protection period expires. In India, trademarks are protected under the Trade Marks Act, 1999, and once registered, a trademark remains valid for ten years from the date of application. To continue enjoying exclusive rights over a brand name, logo, or symbol, the trademark owner must apply for renewal before the expiry date. The renewal application is submitted to the Trademark Registry using Form TM-R along with the prescribed government fees. Renewing a trademark ensures uninterrupted legal protection and prevents other individuals or businesses from using identical or confusingly similar marks. If the renewal application is not filed on time, the trademark may be removed from the official register. However, the law provides a grace period of six months after expiry, during which the trademark can still be renewed by paying additional late fees.
